Terms of Use

These Terms of Use govern your use of LumiNest: Animals, LumiNest: Vehicles, LumiNest: Toys, LumiNest: Food, LumiNest: HomeObjects, and LumiNest: Expressions and other LumiNest apps or services that link to these Terms.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the apps for personal, non-commercial use, subject to these Terms and any platform rules that apply through Apple.

2. Parent Or Caregiver Agreement

These Terms form an agreement between Iterica and the parent, caregiver, or other adult who downloads, purchases, or manages the app on a child’s behalf.

3. Parent Responsibility

The apps are designed for children to use with parent or caregiver oversight. You are responsible for supervising purchases, settings changes, and the child’s use of the apps.

4. Purchases

Paid features and one-time purchases are processed through Apple. Pricing, refunds, and billing are governed by Apple’s rules and your agreement with Apple.

5. Calm, Child-Focused Use

LumiNest apps are designed as simple, child-friendly learning experiences. You agree not to use the apps in a way that interferes with their intended family use, safety features, or purchase controls.

6. Acceptable Use

Do not copy, resell, or commercially distribute the apps or content.
Do not attempt to reverse engineer, interfere with, or misuse the apps.
Do not use the apps in a way that violates applicable law.

7. Educational Content

The apps are intended to support early learning and vocabulary exposure. They are not a substitute for professional educational, developmental, medical, or therapeutic advice.

8. Intellectual Property

The apps, branding, layouts, media, and related materials are owned by or licensed to Iterica and are protected by applicable intellectual property laws.

9. Availability And Updates

We may update, improve, pause, or discontinue parts of the apps at any time, including categories, languages, media, and settings. We do not guarantee uninterrupted availability.

10. Disclaimers

The apps are provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee that the apps will always be error free or available without interruption.

11. Limitation of Liability

To the maximum extent permitted by law, Iterica is not liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the apps.

12. Changes To These Terms

We may update these Terms from time to time. The latest version will be posted at https://luminest.iterica.app/terms/. Continued use after an update means you accept the revised Terms, to the extent allowed by law.

13. Governing Law

These Terms are governed by the laws of The Netherlands, without regard to conflict-of-law principles, unless mandatory local law requires otherwise.
